recall cost handling Extension 2.5 Product Withdrawal Costs: 'the Underwriters will indemnify the Insured for 80% of those costs incurred with the prior approval of the Underwriters in the withdrawal or recall from use in New Zealand of the Insured's Products that have the same defect as other Insured's Products that have already given rise to a claim in respect of which the Insured is entitled to indemnity under this Coverage Section,' subject to Product Withdrawal Costs Sublimit of Liability and applicable Excess. Exclusion 5.18 otherwise excludes recall of products. reparation orders covered "Order for Reparation under the HSW Act" means an order for reparation imposed by the Court on sentencing following conviction of an Insured for an offence under the Health and Safety at Work Act 2015. Exclusion 4.14 states: 'for any monetary amount ordered to be paid by the Insured by way of an order for reparation imposed by a Court following conviction under any Act of Parliament, except an Order for Reparation under the HSW Act.' Notwithstanding exclusion 6 (Fines and penalties) of this broadform liability section, we will cover you for your legal liability to pay an award of reparation in respect of personal injury or damage to property happening within the geographical limits during the period of insurance as a result of an occurrence in connection with the business. Our liability for Sentencing Act reparation claims will not exceed the limit of indemnity shown in the schedule or $10,000,000, whichever is the lesser. This extension does not cover reparation arising from prosecution of an offence under the Health and Safety at Work Act 2015 (or any replacement Act) and any subsequent amendments. retroactive date handling The Retroactive Date means the date set forth in Item 6 of the Schedule. Employers Liability: 'the Personal Injury arose out of an event, circumstance or accident that occurred on or after the Retroactive Date and before the expiry of the Policy Period.' Statutory Liability: 'the Event giving rise to the Claim occurred on or after the Retroactive Date.' Exclusion 4.15 excludes claims 'that arose directly or indirectly out of any event, circumstances or accident that occurred prior to the Retroactive Date.' The personal injury must have occurred on or after the retroactive date shown in the schedule. Exclusion 9 (Prior injury) excludes any personal injury sustained before the retroactive date shown in the schedule. The continuous cover extension provides that where you first became aware of any claim after the continuity date and before the period of insurance, and you do not notify us until during the period of insurance, we will accept notification provided we have continuously been your employers liability insurer from and after the continuity date.
